Terms & Conditions

This Service Agreement (“Agreement”) is entered into by Ace English Academy Pty Ltd and/or Ace PTE and/or Ace Language (referred to as “Ace English Academy Pty Ltd,” “Ace PTE,” “Ace Language,” “we,” “our,” or “us”) and the enrolling student (referred to as “you,” “student,” or “client”).

By enrolling in any course or registering for services at Ace Language, you agree to be bound by the terms outlined in this Agreement.

1. Intellectual Property and Course Materials

1.1. All courses offered by Ace Language contain copyrighted material and proprietary
content from various sources.
1.2. You may not modify, publish, distribute, share, sell, or otherwise exploit any such
material in whole or in part without written authorisation.

2. Course Commencement and Structure

2.1. Your Commencement Date is defined as the date of your first Lecture Class.
2.2. If you do not attend a lecture within 10 days from your payment date, your course will be
deemed “Commenced” unless you have received written approval from Ace Language
management.
2.3. Courses comprising multiple components (e.g., Basic, Lectures, Practices etc.) do not
have separate commencement points. The initial lecture commencement date applies to the
entire course.

3. Trial Classes

3.1. Ace Language does not offer free trial classes.

4. Refund Policy

Refunds are available only under the conditions below:

Full Refunds:
• If you notify us of dissatisfaction with the class on the day of the first lecture (Commencement Date).

Partial Refunds (50%):
• In cases of compelling medical or compassionate circumstances, provided valid documentation (e.g., medical certificate) is submitted.

No Refunds:
• If you change your mind.
• Due to changes in your personal, professional, or immigration status.
• If you raise concerns about class quality two working days after the first lecture.
• If you fail to attend a class within 10 business days of payment or agreed start date.
• If you relocate from a city where Ace Language operates, and only online class is available.

5. Course Upgrades and Downgrades

Upgrades:
• Allowed by paying the difference in course fees.
• Calculations are based on current full prices; past discounts are not retained.
• No refunds are given if the desired course is currently cheaper than the original course.

Downgrades:
• Allowed with a refund of the fee difference.
• Not allowed if the student has completed more than half of the course.

6. Delivery and Service Timelines

6.1. Services and materials (online or offline) are delivered gradually, subject to resource availability.
6.2. Response times may vary. We aim for under 24 hours but do not guarantee it.
6.3. Weekend and after-hours requests may be delayed.

7. Communication Delays

7.1. For delays exceeding 48 hours, please escalate by emailing the management at: info@acepte.com.au
7.2. Delays do not entitle students to refunds.

8. Learning Materials

8.1. Materials such as laptops, handouts, or software tools may be provided, but availability is not guaranteed.

9. Course Extension

9.1. Extensions are only granted for medical reasons affecting your ability to attend.
9.2. A medical certificate is required, and the request must be made promptly.
9.3. Extensions only apply to the missed classes.

10. Course Suspension or Deferment

Allowed only in compelling circumstances, including:
• Medical incapacity (supported by a certificate)
• Bereavement (with documentation)
• Visa delays or travel disruptions
Requests must be submitted in writing with supporting evidence.

11. Non-Transferability

Courses, services, or materials cannot be shared or transferred to others without prior written consent from management.

12. Public Holidays and Scheduling

Ace Language may not operate on public holidays. Make-up sessions will be arranged within the course timeline.

13. Course Fees and Promotions

13.1. Fees are set by Ace Language management and are non-negotiable.
13.2. Promotions may vary over time. Discounts available at the time of original enrolment will not be applied retroactively.

14. Academic Integrity and Student Responsibility

14.1. Training is provided by experienced instructors.
14.2. No guarantee of academic outcome is made; results depend on student commitment.
14.3. Regular attendance, participation, and independent study are essential.

15. Testimonials and Consent

15.1. We may request a testimonial at course completion.
15.2. We will not share sensitive personal information (e.g., email, ID numbers) with any third party.

16. Media Consent and Promotional Use

16.1. Ace Language may photograph, record, or film classes or student achievements.
16.2. These may be used in marketing (social media, editorials, brochures, etc.)
16.3. No media will be sold or shared with third parties.
16.4. Students may request their face or name to be withheld from promotional use.
16.5. If you do not wish your information or images to be used, please inform us at the time of enrolment.

17. Privacy and Global Data Use

Ace Language is committed to protecting your privacy and complying with the Privacy Act
1988 (Cth) and the Australian Privacy Principles (APPs). This policy applies to all
students worldwide.

17.1. What We Collect

We may collect:
• Names, contact details, and student IDs
• Payment and course information
• IP address and device data
• Images, testimonials, or recordings (with consent)
• Sensitive information with explicit consent

17.2. How We Use Your Data

  • To deliver and improve our services
  • To communicate and support you
  • For internal analytics and compliance
  • For marketing (with your consent or implied agreement, see Clause 16)

17.3. Sharing and Disclosure

Your data may be shared with:
• Trusted service providers
• Legal or regulatory authorities if required
• Overseas partners for hosting or delivery (data is protected under APPs)

17.4. Your Rights

You can request:
• Access to your personal data
• Updates or corrections
• Removal of certain data, where allowed by law

18. Amendments to Terms

Ace Language reserves the right to amend this Agreement and Privacy Policy at any time. Continued use of our services constitutes your acceptance of the revised terms.

19. Enrolment Confirmation

To complete enrolment, you must:
• Submit the enrolment form
• Pay the course fee in full

20. Governing Law

This Agreement is governed by the laws of New South Wales, Australia, and applies to all students, regardless of nationality or residence.

Student Declaration

By enrolling in any course or service at Ace Language, you confirm that you have read, understood, and agreed to all terms, refund conditions, and privacy obligations outlined above.
